In honor of schools getting back into session, we thought it would be a great time to have our divorce expert, Colin Amos from Goldberg Jones, drop by and give us all a little lesson about protecting ourselves, our finances and our families from a messy breakup or divorce.
Amos first broke down the steps of dealing with a restraining order. Even if served with a restraining order, fathers still have the option of seeing their children. If someone has been served with a restraining order, Amos insists that the recipient request a hearing to determine whether the order was justly or unjustly given. When someone gets a restraining order, it is often because the judge or whoever upheld the order only heard one side of the story.In the case of divorce, there are children involved and people need to hear each party’s side of the story to determine if the restraining order should be granted or not. And since divorce cases involve the well being of children, a hearing will be scheduled within 30 days of the request.
Amos also went into detail about the problems with individuals who threaten to end a relationship and get their partners kicked out of their residence. In his experience, when someone goes to that degree of threat, it’s a preview of what is to come. He or she is telling you what they are going to do and it’s only a matter of time before they follow through with it. If things cannot be worked out peacefully and rationally, Amos insists that you get him involved.
